The United States Court of Appeals for the Seventh Circuit recently affirmed the granting of an insurer’s motion for summary judgment, finding no coverage for a settlement for defective work entered into between a condominium association and a contractor. The association’s cause of action was based on a theory of implied warranty of habitability.
