CM Client Quest Diagnostics Prevails in Venipuncture Jury Trial
A former banker who previously sued Citibank claiming that she was let go because she was “too sexy,” lost her lawsuit against Quest Diagnostics on February 5, 2016. Debrahlee Lorenzana claimed that she was permanently injured in connection with a blood draw conducted by a Quest Diagnostics phlebotomist. In particular, Ms. Lorenzana alleged that following the blood draw she suffered from various injuries, including Complex Regional Pain Syndrome or CRPS. Following an 8-day trial before a Queens County, NY jury, the jury returned a verdict for the Company on all counts and awarded Ms. Lorenzana nothing. The verdict in this case demonstrates further that juries are skeptical of claims alleging nerve damage and injury arising from venipuncture, one of the most common medical procedures performed in the country.
