Keith G. Flanagan

Keith G. Flanagan is a partner in Clausen Miller's Chicago office, where he concentrates his practice in the areas of insurance coverage and related litigation, commercial litigation and bank litigation.  Keith obtained his B.A. from Georgetown University, and went on to earn his law degree from the Boston University School of Law.

Keith has extensive experience representing insurers in coverage disputes, particularly in the areas of fidelity and surety bonds, directors and officers' liability insurance, and other related coverages.  He has represented domestic and international insurers in coverage evaluation and litigation, and in their recovery efforts.

Keith has represented insurers and sureties in a variety of coverage disputes in both state and federal courts throughout the United States and abroad.  His recent assignments have included:

  • Representing sureties on claims involving both performance and payment bond claims throughout the Midwest, including the drafting and negotiating of takeover and completion agreements.
  • Representing an international insurer in a complex warehouse lending scheme including both bond and liability claims.
  • Representing national insurers in a wide variety of D&O claims, including claims related to entity, trust department and lender liability coverages.
  • Representing various insurers in multimillion dollar recovery efforts against various financial institutions, including claims arising under the Uniform Commercial Code and Uniform Fiduciary Obligations Act.
  • Representing a national insurance company in a $9 million bankruptcy recovery action.

Keith recently served as Co-Chair of the Young Professionals Section of the American Bar Association's Fidelity and Surety Law Committee and is a Practice Tips Editor for the Fidelity & Surety Digest.  He is also an active member of the Surety and Fidelity Claims Institute and National Bond Claims Association.  He is a frequent lecturer in the area of fidelity and surety claims and has written numerous articles related to those areas.
