Diane M. Baron

Diane M. Baron is a partner with Clausen Miller P.C. with extensive litigation experience in the defense of health care liability cases, including the representation of psychologists, therapists, social workers, counselors, psychiatrists, physicians, nurses, nursing homes and home health care agencies in the state and federal courts as well as before the Illinois Department of Professional Regulation. She has defended cases involving professional negligence, including failure to properly diagnose, treat and/or refer, misprescription of medication, repressed memory, undue familiarity and failure to prevent suicide. She has also litigated claims of breach of confidentiality and defamation involving mental health care providers. Ms. Baron also has extensive experience in defending other types of health care malpractice cases, including the representation of physicians, nurses, nursing homes and home health care agencies. She has also litigated cases involving illnesses such as salmonella and hepatitis.  Ms. Baron has also represented other professionals, such as insurance brokers and attorneys, in malpractice cases.

Ms. Baron also has extensive experience in employment law, including Title VII, Age Discrimination in Employment Act (ADEA), Americans with Disabilities Act (ADA), Family Medical Leave Act (FMLA), due process, First Amendment, sexual harassment and retaliatory discharge claims. In school cases and employment cases, she has litigated in the state and federal courts as well as before the Illinois Department of Human Rights and the Illinois Human Rights Commission. She has also defended municipal entities in voting rights, discrimination cases and in other cases involving alleged violations of constitutional rights.  Ms. Baron also has experience in insurance coverage matters, including the litigation of coverage disputes in the state, federal and bankruptcy courts.

Ms. Baron was admitted to the Illinois Bar in 1984 and the New York Bar in 1997. She graduated from Northwestern University, receiving a B.S. degree with high honors and a Juris Doctor degree. Ms. Baron is a member of the Chicago Bar Association.
