Ciprian Dogaru is an associate in the Irvine office of Clausen Miller P.C.  His practice focuses on commercial and business litigation, and insurance coverage, litigation and regulation. 

BUSINESS AND COMMERCIAL LITIGATION


Ciprian represents businesses in commercial and business litigation ranging from simple contract disputes to complex multi-party disputes in numerous industries including construction, real estate, technology, financial services, manufacturing, health care, and professional services.  His experience includes unfair competition and deceptive advertising claims (California Business and Professions Code Sections 17200 and 17500), non-competition disputes, misrepresentation and fraud claims, partnership disputes, interference with economic advantage allegations, equipment leasing disputes, defense of consumer litigation, and class action litigation.  He also has experience in defending architects, engineers, accountants, mortgage brokers, and contractors in high-stakes liability cases threatening their business reputation and economic survival.

First-Party Commercial Property Insurance
Ciprian counsels commercial property insurers in all aspects of first-party property insurance coverage in a myriad of industries including storage warehouses, manufacturing plants, industrial facilities, hotels and resorts, food processing plants, pharmaceutical facilities, office buildings, apartment complexes, mobile home parks, water parks, and casinos.  His expertise includes a broad array of policies, manuscript and ISO forms, such as all-risk, named perils, boiler and machinery, inland marine, and builder’s risk.  He regularly advises property insurers regarding business interruption, contingent business interruption, extended period of indemnity, property damage, ensuing loss, proximate causation, number of occurrences, application of deductibles, scheduled versus blanket coverage, civil authority, environmental contamination, sue and labor, extra expense coverage, and underwriting issues.

Ciprian also represents property insurers in high-exposure litigation, in state and federal courts, alleging breach of contract, “bad faith” and punitive damages claims. 

Commercial General Liability Insurance
Ciprian counsels commercial general liability insurers on a wide range of issues, including the duty to defend and indemnify in the context of bodily injury, property damage, personal and advertising injury, misappropriation of trade secrets, business torts, construction defect, land movement, environmental claims, toxic tort claims, corporate succession and named insured issues, and the interpretation of excess and umbrella policies, including “drop down” issues.  He also represents commercial general liability insurers in declaratory judgment actions, and lawsuits alleging bad faith and extra-contractual claims.

Errors And Omissions/Professional Liability Insurance
Ciprian advises insurers on coverage issues arising under errors and omissions, and professional liability policies, including policies issued to mortgage brokers, real estate agents, and accountants.   

Insurance Regulation
Ciprian represents admitted and surplus lines insurers in matters before the California Department of Insurance, including hearings, administrative audits, regulatory compliance, and administrative investigations involving allegations of unfair claim practices.
