Brian E. DeVilling
Associate
Brian E. DeVilling is an associate at Clausen Miller P.C. He received his juris doctor from Loyola University Chicago School of Law and attended the University of Michigan, Ann Arbor as an undergraduate, where he received a Bachelor of Arts in English Language and Literature and Political Science.
Mr. DeVilling handles the defense of complex product liability, premises liability, and medical malpractice cases on behalf of companies and individuals. Mr. DeVilling has assisted in the defense of cases involving allegations of negligent manufacture and design, negligent failure to warn, breach of warranty, and strict liability of medical, consumer, and industrial products. He has assisted in the defense of bariatric surgeons, emergency room physicians, and physician assistants accused of negligence. Mr. DeVilling has litigated cases around the country, including Illinois, Michigan, Alabama, Texas, California, Maryland, Montana, Indiana, and Iowa.
Mr. DeVilling also handles a variety of business and commercial matters involving companies of all sizes. He has represented plaintiffs and defendants in cases involving director and officer liability, securities fraud, breach of contract, breach of covenants not to compete, wrongful discharge, collection matters under the Uniform Commercial Code, violation of trade secret laws, and fraudulent transfers under the Uniform Fraudulent Transfer Act. Mr. DeVilling has also assisted in a variety of transactional matters, including the formation of limited liability companies, implementation of corporate succession plans, consultation with companies on employment issues, drafting of non-solicitation agreements and covenants not to compete, and drafting and review of sales contracts.
Mr. DeVilling is an Adjunct Professor of Advocacy at Loyola University Chicago School of Law, where he serves as a head coach to Loyola’s mock trial team and guest instructor to trial practice classes. He is a member of the ABA Section of Business Law, ABA Section of Litigation, and ABA Subcommittees on Trial Practice, Trial Evidence, and Pretrial Litigation. He has written and published articles on a variety of subjects, including the chapter on "Writings at Trial" in the 2004 edition of Illinois Civil Trial Evidence.
While in law school, Mr. DeVilling was a two year recipient of the Philip H. Corboy Fellowship in Trial Advocacy and a member of Loyola's Philip H. Corboy Trial Team, where he participated in six national competitions and earned the following honors: National Champion, 2000 William W. Daniel National Mock Trial Invitational; Midwest Regional Champion, 2001 Association of Trial Lawyers of America Student Trial Advocacy Competition; National Semi-finalist, 2002, Georgetown University National White Collar Crime Mock Trial Competition; and Regional Finalist, 2002 Young Texas Lawyers National Mock Trial Competition. Mr. DeVilling was the Senior Editor of the Loyola Consumer Law Review and a contributing author to the Cornell Online Journal of Legal Ethics, where he authored a section on pro hac vice admission and multi-jurisdictional practice. Mr. DeVilling also taught a high school law class through Loyola’s Street Law program.
Prior to law school, Mr. DeVilling was active in politics, serving as the Political Director on a 1996 campaign for United States Congress, officer on the Michigan 12th Congressional District Republican Committee, and member of the Michigan State Republican Committee.
