Gozdziak Presents First-Party Property Case Law Update To CNA

Clausen Miller partner Thomas Gozdziak made a presentation to nearly 30 property insurance professionals at CNA. The presentation, titled "Case Law Update: Property Claims Law," addressed almost 60 recent decisions from 2008 and 2009 on various first-party property issues, including:

-denial letters                                       -concurrent causation
-examinations under oath                 -anti-concurrent causation clauses
-overhead and profit                            -actual repair costs
-actual cash value                               -misrepresentation
-insurable interest                               -business interruption
-financial interest                                 -other insurance
-replacement cost                               -all risk insurance is not a maintenance contract
-duty to cooperate                                -ordinance or law exclusion
-physical damage                                -lost rents
-collapse                                                -extra expense
-valuation                                                -spoliation of evidence
-increased cost of construction coverage  
-vacant and unoccupied property exclusion 
-right to examine insured's tax records
