Lack of early involvement of counsel proves fatal to maintaining a suit where a fire occurred at a surgical mask manufacturing facility and counsel and C & O experts were not initially retained. Local fire authorities sealed off the scene for several months. Once the scene was released, the critical evidence had been disturbed or removed from the scene and, therefore, subrogation was impossible.

Early investigation reveals contractual bar where a heavy strip mining machine was damaged by fire. The machine was part of a sophisticated network of machinery used to excavate coal in China. Upon start up of the machine following alterations, a fire occurred, damaging the machine, and other equipment. Subrogation counsel and an appropriate expert were retained and soon after determined contractual waiver of subrogation prevented a recovery, in an otherwise ideal subrogation setting.
