Jack J. Murphy, an associate at Clausen Miller, was recently published in the Illinois Association of Defense Trial Counsel Quarterly as a co-author if the IDC Monograph, the feature article of the Quarterly which provides an in-depth analysis of current legal issues. Mr. Murphy has been a member of the Association for three years and is currently on the Employment Law Committee.
The article, which he co-authored, is entitled A Guide to the Family Medical Leave Act of 1993 and New FMLA Regulations. It provides a comprehensive guide to the FMLA regulations focusing on the regulatory changes present in the Department of Labor's final rules, including the new notice requirements, modification of the definition of "serious health condition", new provisions for service-members and the increased scope of liability faced by employers. In addition, the article analyzes recent case law in the Seventh Circuit Court of Appeals interpreting the elements of a prima facie case of deprivation of rights and retaliation claims under the FMLA, employer obligations under the FMLA and the Department of Labor's enforcement of the FMLA.
