Henson Wins Second Labor Arbitration

Christopher R. Henson won the second of three labor arbitrations concerning the termination of union officials who were members of the International United Auto Workers Union ("UAW"). In Android Industries v. UAW and Local #1268 (FMCS Case No. 07-04848), Arbitrator Raymond E. McAlpin issued a 17 page decision upholding the termination of the Unit Chairperson for Local #1268 for engaging in or condoning an illegal work stoppage. The arbitration took over three days with over twenty witnesses called to provide testimony. The Arbitrator found the termination of the Grievant was not motivated by illegal animus towards the UAW and that the Employer correctly applied the express terms of the Collective Bargaining Agreement in terminating the Union Official. The Arbitrator noted that while the UAW "put on an exceptionally aggressive case on behalf the Grievant", such representation did not preclude the finding that the Grievant's termination was ultimately proper. This is the second decision in the aftermath of the termination of UAW officials arising out of events that occurred the week of July 16-23, 2007 at the Android Industries plant in Belvidere, Illinois.
