Hoey and Kollross Win Coverage Dispute For American Zurich In Trial and Appellate Courts

CM partner James H. Hoey won summary judgment in the trial court while CM partner Melinda S. Kollross obtained affirmance on appeal in Hickory Properties v. American Zurich (10-2972). The case was highlighted in the June 10, 2011 Chicago Daily Law Bulletin, reporting that the court ruled that trees aren't part of a "building" in the case of a golf course that sustained heavy damage in a windstorm. The insured had claimed coverage for an alleged several millions of dollars worth of tree damage. The court agreed with Zurich and Clausen Miller that the alleged tree damage was subject to a $25,000 limit, which Zurich had already paid in full.
