Rauchwerger & Wysocki Score Deductible Reimbursement Recovery Victory In MN Federal Court

CM partner, Dean S. Rauchwerger, and associate, Kenneth R. Wysocki, score a significant victory in a deductible recovery case pending in the U.S. District Court for the District of Minnesota.  In Scottsdale Insurance Company v. Westurn Cedar Supply Inc. et al, Case No. 07-2674, CM represented plaintiff, Scottsdale Insurance Company, for reimbursement of its advanced deductibles from its insured. 

Scottsdale issued several insurance policies to various defendant roofing companies, each containing a $5,000 deductible reimbursement provision.   When defendants stopped making the required deductible reimbursements, Scottsdale filed suit in Minnesota Federal Court to recover the monies owed.

Instead of engaging in drawn-out discovery or a costly trial, CM’s Rauchwerger and Wysocki strategically filed an offensive Rule 56 summary judgment motion. On July 31, 2008, the District Court granted Scottsdale’s motion and entered judgment in Scottsdale’s favor for $750,905.35.  The Court ruled that defendant also had a continuing obligation to provide its deductible reimbursement payments.
