Appellate Group Obtains Favorable Defense Opinion on "Natural Accumulation" Rule

Clausen Miller Appellate Practice Group Edward M. Kay, Paul V. Esposito, Kimbley A Kearney, Kimberly A. Hartman and Joseph J. Ferrini obtained a favorable defense opinion from The Illinois Appellate Court, First District. The Appellate Court held that a landowner has no duty to remove naturally accumulated dirt from a sidewalk on property absent a showing that the landowner created or was aware of a hazardous condition. Wasim Sam Ahmed v. Pickwick Place Owners’ Ass’n and Vista Property Management, Inc., No. 1-07-2047, ---N.E.2d---, 2008 WL 4445175 (Ill. App. 1st Dist. Sept. 30, 2008).
