Scanlon Scores Victory In U.S. Court To Enforce A CIETAC Ruling For Chinese Client
October 5, 2010
CM Partner Christopher T. Scanlon achieved a Judgment in the U.S. District Court of New Jersey to enforce a China International Economic and Trade Arbitration Commission (CIETAC) decision on behalf of a Chinese manufacturing client, who sued a U.S. company for breach of contract.
The U.S. company argued that it did not receive a fair opportunity to fully and fairly present its case to the arbitration Commission. CM attorneys argued the contrary, presenting evidence showing that CIETAC allowed for a full presentation of the case, and provided an impartial arbitration proceeding that meets international trade standards. The Court found for the Chinese company and ruled to enforce the judgment in full, including interest.
