Howser Scores Defense Verdict In Products Liability Case
January 26, 2010
Clausen Miller partner Rick Howser recently obtained a not guilty verdict in favor of a client in a product liability case after a week long jury trial in Federal District Court in Chicago.
Clausen Miller (CM) represented one of the largest RV manufacturers in the country. Plaintiff alleged that the electrical stair step control module on the vehicle was defective, causing the RV's outside steps to unexpectedly retract, resulting in plaintiff's injury. They presented evidence through their electrical engineering expert that the electrical stair step was not defective and could not have failed in the manner described by Plaintiff.
Plaintiff's attorney asked the jury for $2.5 million. Plaintiff's settlement demand remained in the seven figures as the jury deliberated. The defense verdict was truly a team victory with CM's Appellate Practice Group, paralegals, legal researchers and law clerks all providing invaluable assistance in the pretrial preparations and trial effort.
