95% Recovery for Faulty Generator Repairs

Chicago Subrogation Partners Martin Sener and Robert Wilens settled a case in conjunction with other plaintiff's counsel in Maricopa County, Arizona where they recovered 95% of their client's property damage payment. The recovery was made against a firm that completed repairs to a hydrogen cooled generator which was being used at a power plant. The repairs in question were completed in order to address core looseness within the generator. The repair method utilized during a re-wind of the generator's end-windings did not mimic that of the original equipment manufacturer, in that significant gaps were left between the strands and the hydrogen cooled vents. Within several months following completion of the repairs, and without any extra-ordinary operating parameters, the generator overheated, and suffered a catastrophic failure.
The case was settled after disclosure of experts, but before any expert depositions had been completed.
