Missouri Court Of Appeals Affirmed Clausen Miller's $29,000,000 Verdict For Client

March 27, 2008

The Missouri Court of Appeals affirmed the jury verdict of $29,000,000 in favor of Clausen Miller's client Newell Rubbermaid, Inc. and against lighting installer Efficient Solutions, Inc.  Clausen Miller partners James J. Bigoness and James F. Smith successfully tried the case before a jury in St. Francois County, Missouri in July and August, 2006.  The jury found that Efficient Solutions was negligent and responsible for the fire which destroyed the warehouse portion of the Farmington, Missouri factory which manufactured children's playground equipment.  The jury found that Efficient Solutions should have installed safety chains on the overhead industrial lighting which would have prevented a light from falling to the ground and igniting cardboard packaging and plastic products. The judgment amount, including post-trial interest, totaled over $32,400,000.
