Henson Won Labor Arbitration

March 26, 2008

Christopher R. Henson won a labor arbitration regarding a termination of a union official for violations of the Collective Bargaining Agreement ("CBA").  In Bryan Gary and United Auto Workers v. Android Industries (FMCS No. 070927-04847-A) the grievant alleged he was unjustly terminated for conducting union business, as an elected officer, by the company.  Mr. Henson represented the employer, Android Industries.  The arbitration lasted approximately ten hours, with numerous witnesses and documents entered into evidence.  In a 15 page decision, Arbitrator William Sigler sided with the company, holding that the penalty of termination was justly imposed by Android.  The grievant's claim was denied in its entirety.
