Kimberly A. Hartman is an associate in the Chicago office of Clausen Miller P.C. Ms. Hartman is part of the firm's Appellate Practice Group, and has prosecuted and defended appeals across the nation in a variety of practice areas, including construction litigation, first-party property, insurance coverage, products liability, professional liability, and wrongful death/survival.
In addition to her appellate work, Ms. Hartman also acts as trial monitoring counsel in high-exposure cases. As part of this practice, she partners with local trial counsel to prepare dispositive pretrial motions, motions in limine, motions for directed verdict, jury instructions, verdict forms and posttrial motions. She also assists in the development of overall trial strategy to insure a successful trial outcome and a properly postured appeal.
Her recent victories include: Terminal Ventures, Inc. v. Traveler's Ins., et. al., No. A-3944-07T3 (N.J. Super. A.D. 07/09/09) (summary judgment for insurer based upon a lack of efficient cause affirmed on appeal); Almeroth v. Doermer, et. al., No. 1-08-1476 (Ill. App. 1 Dist. 06/30/10) (persuaded appellate court to apply the loss causation doctrine to actions against financial planners); DMP Contr. Corp. v. Essex Insurance Co., Slip Opinion No. 06548 N.Y.A.D. 1 Dept. 09/14/10) (convinced appellate court to uphold a contested insurance policy exclusion as clear and unambiguous); Coronado v. Valleyview Public School District, 537 F.3d 791 (7th Cir. 2008) (persuaded appellate court to uphold expulsion of a student involved in single gang-related incident); Commercial Warehouse & Cartage, Inc., et. al. v. Shipp, No. 49D10-0408-CT-001584 (Ind. App. 2008) (negotiated a favorable settlement of a multi-million dollar jury verdict on appeal).
Ms. Hartman received a J.D. from the University of Maryland School of Law in 2002, and a B.A. in Political Science cum laude from Clemson University, Calhoun Honors College in 1999. During law school, Ms. Hartman was a member of Maryland's Moot Court Board, and also participated in a clinical program where she represented indigent clients in benefits, employment and other civil disputes.
