Medical Malpractice Defense Group Received Another Lasik Case Defense Verdict
On June 7th, Partner Neil H. Ekblom received another Lasik defense verdict in Craig Brown and Michelle Brown v. Mark G. Speaker, Laser and Corneal Surgery Associates PC and TLC Laser Eye Center and William Tullo, MD. (Index no. 105230/02). Plaintiff's attorney was Hunter Shkolnik of Rheingold, Valet, well known in N.Y. and other states for some very large verdicts.

In Face of Approximately 30 Million Jury Demand, CM Convinced Jury to Award Plaintiff Only $270,084
Clausen Miller partners James M. Hoey, Thomas S. Gozdziak and Tracey A. Jordan obtained a very favorable result for client Three Rivers Insurance Company after a 3 week jury trial in the U.S. District Court for the Western District of Pennsylvania. The case involved the 2001 collapse of a large piece of machinery called a stacker/reclaimer which was used at the plaintiff's bauxite mining & shipping operation located in Guinea, West Africa. Bauxite is the raw material used to make aluminum.

Partners Ritchie & Zidek Got Late Call and Pulled Out a Victory
Clausen Miller Partners P. Scott Ritchie and Michael Zidek were called late in December to take over a case scheduled for trial in only five weeks. The case involved a woman who claimed she was severely injured when a purported malfunctioning hydraulic door closer caused the heavy wooden door of the restaurant she was entering to slam on her back and foot. She obtained treatment from 18 different medical providers.

Clausen Miller Attorneys Achieved Victory for Essex Insurance
Clausen Miller attorneys Melinda S. Kollross, Steven N. Novosad and Chip G. Schoneberger made the front page of the Chicago Daily Law Bulletin on Monday, February 12, 2007. Representing Essex Insurance, a summary judgment was obtained and then affirmed on appeal. At issue was O'Hare Auto Recycling's alleged destruction of a sport utility vehicle needed as evidence in a product liability suit. Essex argued that its policy does not cover a spoliation of evidence claim.
