Recent Defense Victory For Two Clausen Miller New York Attorneys
Plaintiff suffered personal injuries while on the job, and he and his wife filed suit against the alleged tortfeasors. He also sought workers' compensation benefits from his employer's workers' compensation carrier, Clausen Miller's (CM) client. While the workers' compensation hearings were still on-going (no decision was made by the Workers' Compensation Board as to Plaintiff's classification), Plaintiff and his wife jointly settled the civil litigation.

Product Liability & Appellate Departments Refute Plaintiff's Design Defect Claims
P. Scott Ritchie and Christopher Henson of the product liability practice group of the Chicago office of Clausen Miller P.C. received summary judgment from Clark County, Illinois Judge, Tracy W. Resch, on behalf of their client, Panasonic. In the complaint, it was alleged that the Plaintiff was injured by a moving carriage while attempting to evaluate an adjustment he made on a high speed placement machine manufactured by Panasonic.

A fire ensued within a strip mall in Linwood, New Jersey. Clausen Miller's clients (the insurers) insured several retail spaces within the mall. Clausen Miller Partner Robert A. Clausen Miller's client's Insured operated a pizzeria in strip mall in West Boylston, Massachusetts. A fire ensued in another tenant's space within the strip mall. The fire and smoke spread to the Pizzeria. The Insured actually suffered the worst damage of any of the tenants.

No Coverage for $6M Sale of Moldy Bales Of Cotton Affirmed By 8th Cir. In CGL & Propty Coverage Win
The 8th U.S. Circuit Court of Appeals recently affirmed the grant of two separate summary judgments obtained by CM partners Amy Rich Paulus and Mark D. Paulson, holding that the insurer they represented had no duty to defend or indemnify a cotton gin operator accused of selling more than 50,000 bales of moldy cotton. The Court affirmed the two judgments, one under a CGL coverage form and the other under a Property coverage form.

China Opens Its First Finance Court
China recently opened its first court to deal specifically with financial disputes. The financial court was founded by Pudong Financial Service Office and Pudong People’s Court. The court is administered under the jurisdiction of the Shanghai Pudong New Area District People’s Court. The Court is named as the “Sixth Civil Court of Pudong People’s Court."

Clausen Miller's East Coast Coverage Group Obtains Summary Judgment
On July 9, 2009, the Appellate Division of the Superior Court of New Jersey affirmed the grant of summary judgment obtained by CM Partner Ruth V. Simon (New Jersey Office), in a coverage action in which the insured sought business interruption coverage for the collapse of its dock. The Insured, an oil storage terminal, initially claimed that it had a flood loss and sought $2.1 million from its Insurer (CM's client).
