Judgment Reversed And Entered For Essex Ins. Co. In Coverage Case
The Illinois Appellate Court, Second District reversed the trial court's decision and entered judgment for Essex Insurance Company. This case involved a question of whether there was insurance coverage against a developer/general contractor for claims of construction defect brought by a purchaser of a town home and a claim for indemnity by a home warranty company.

95% Recovery for Faulty Generator Repairs
Chicago Subrogation Partners Martin Sener and Robert Wilens settled a case in conjunction with other plaintiff's counsel in Maricopa County, Arizona where they recovered 95% of their client's property damage payment. The recovery was made against a firm that completed repairs to a hydrogen cooled generator which was being used at a power plant.

FL Appellate Court Affirmed CM Summary Judgment On $33 Million Extra Expense Claim Arising From 9/11
Clausen Miller partners Andrew C. Jacobson and Kirk M. Zapp successfully obtained summary judgment on behalf of six primary and excess property insurers in the Circuit Court of the 17th Judicial Circuit for Broward County, Florida in ANC Rental Corp. v. Lexington Ins. Co., Case No. 03-021499. Clausen Miller partner Melinda S. Kollross successfully handled the appeal.

A St. Francois County, Missouri jury returned one of Missouri’s largest tort verdicts in favor of Clausen Miller client, Newell Rubbermaid d/b/a Little Tikes, in the amount of $29,000,000 in a case tried by James F. Smith and James J. Bigoness and assisted by Richard Strawbridge.

Richard Murphy and Betsy Grover Won Verdict For Gastroenterologists
58-year-old Joan Mayers was admitted to Good Shepherd Hospital on December 20, 1998 with severe abdominal pain and died three days later. An autopsy revealed the cause of death to be a thrombotic occlusion of the superior mesenteric artery, leading to bowel necrosis, gangrene, bowel perforation and sepsis.
