Patrick McGuire is Of Counsel to Clausen Miller. He has more than 24 years of experience litigating complex insurance-coverage disputes, including claims involving environmental pollution, toxic torts, products liability, professional liability, construction defects, vehicle accidents, premises liability, disabilities, fires, tornadoes, crimes, excess judgments, bad faith, and fraud. Patrick has taken cases to verdict in both jury and bench trials, handled appeals, and resolved hundreds of claims through appraisal, mediation, arbitration, pre-trial motion practice, and settlement negotiations.
Patrick has also built a national reputation as an expert on the intersection of insurance and automotive laws. He regularly assists clients with the design and implementation of compliance programs and provides strategic advice as to the practical impact of existing or proposed regulations or legislation to entities ranging from small businesses to trade associations to Fortune 50 companies. As a legislative consultant and subject-matter expert, he has helped clients develop lobbying strategies, drafted proposed bills and amendments, and has testified before numerous state legislatures and the National Conference of Insurance Legislators (NCOIL). Patrick is frequently asked to speak at joint industry events throughout the country on emerging coverage and claims issues, including issues related to data harvesting and privacy, advanced crash-avoidance technologies, changes in traditional models of vehicle ownership and usage (e.g., TNPs and OEM subscriptions), and the liability issues inherent in the shift toward self-driving vehicles (i.e., ADAS). Because the insurance and automotive industries are closely intertwined and heavily regulated, there is no substitute for a deep understanding of the laws that affect both.
Patrick has also served as the outside general counsel for several small businesses, primarily technology start-ups in the automotive and military sectors. As a result, he has experience counseling clients on a wide variety of general corporate matters, including business formation, employment issues, drafting and negotiating purchase agreements and service contracts, and the protection and monetization of intellectual property through licensing agreements.
Patrick received his B.A. degree from Marquette University in 1990 and his J.D. degree from Loyola University Chicago School of Law in 1995. He is licensed in Illinois and admitted to practice before the Illinois Supreme Court and the United States District Court for the Northern District of Illinois. He founded the Law Offices of Patrick J. McGuire, P.C., in 1998.
