Caitlin Bratt Secures Back-to-Back Summary Judgment Victories in Texas
Congratulations to Caitlin Bratt on securing summary judgment victories in two separate lawsuits, one on behalf of a veterinarian and the other on behalf of an insurance agent.
On August 27, 2026, a Tarrant County district court granted summary judgment and dismissed all claims against Caitlin’s client, a Texas veterinarian. The lawsuit arose from a 2016 incident in which the plaintiff’s pet was injured and subsequently brought to the veterinarian for treatment. The veterinarian treated the pet, and neither the care provided nor the pet’s condition upon discharge formed the basis of the plaintiff’s complaint. Instead, the plaintiff alleged that a note in the veterinary records concerning the pet’s injuries was misleading, unverified and damaging to the plaintiff’s reputation. The Court granted summary judgment and dismissal of the claims for defamation, negligence, gross negligence and intentional infliction of emotional distress by demonstrating that the claims were barred by the applicable statutes of limitations and lacked legally sufficient evidence.
The following day, a Collin County court granted Caitlin’s renewed no-evidence motion for summary judgment and dismissed all claims against her client, a Texas insurance agent. The plaintiff filed suit against the agent and several other defendants based on a 2023 incident, asserting claims for negligence, fraud, breach of contract, violations of the Texas Deceptive Trade Practices–Consumer Protection Act and violations of the Texas Debt Collection Act. Following more than a year and a half of written discovery, expert discovery and development of the evidentiary record, Caitlin demonstrated that the plaintiff could produce no evidence supporting the essential elements of the claims against the agent. After considering the motion, the plaintiff’s response and Caitlin’s reply, the court granted the motion and dismissed every claim asserted against her client.
