California Managing Partner Ian Feldman Secures Summary Judgment on Behalf of a Commercial Leasing Agent
A medspa tenant sued its landlord and leasing agent, alleging failure to disclose permitted uses under the City of Santa Monica’s zoning laws. Through targeted deposition questioning, Ian obtained key admissions establishing that the agent was covered by a prior release agreement executed during an unlawful detainer proceeding between the landlord and tenant. At issue was the scope of the release, including the waiver executed by the parties under California Civil Code Section 1542. Ian won a complete defense victory at summary judgment.
