Carl Perri and Marisa Michaelsen Secure Pre-Answer Dismissal With Prejudice for Clients in New Jersey

Carl Perri and Marisa Michaelsen recently obtained a pre-answer dismissal with prejudice in New Jersey, successfully arguing that Plaintiffs could not provide sufficient evidence of proximate causation and damages as to our clients. Plaintiffs alleged numerous causes of action relating to their rental of an apartment, including statutory violations and consumer fraud claims. We successfully argued that our clients’ limited role was not proximately related to the claimed damages suffered by Plaintiffs, and that our clients did not maintain authority or control over the conditions alleged by Plaintiffs. The Court agreed with our arguments and dismissed all counts alleged against our clients with prejudice.
