Goltsman and Capria Get Default Judgment Vacated
Clausen Miller partner Mara Goltsman and associate Alexis Capria obtained a decision vacating the default judgment obtained against our client. We were retained after plaintiff’s counsel succeeded on a default motion against our client, presented plaintiff’s testimony at an inquest and after a default judgment was granted and entered against our client.
Our arguments in favor of vacatur of the default judgment addressed improper service of process of the initial pleading and subsequent improper service and lack of notice to our client. We also argued that there was a meritorious defense and addressed various legal arguments in that regard. Ultimately, the Court agreed with our argument that initial service was improper and vacated the default judgment.
