Mara Goltsman Obtains Summary Judgment for Nursing Home Client
Congratulations to Mara and Clausen Miller’s New York office for another summary judgment win!
The decedent was hospitalized at several hospitals and nursing homes for over 1 year. Plaintiff asserted causes of action against our nursing home client sounding in medical malpractice, negligence and wrongful death. Plaintiff also asserted causes of action against the nursing home under the Public Health Law. Plaintiff’s counsel claimed that the decedent’s bedsores and ulcers were not treated appropriately and that she developed pressure ulcers, infection and sepsis as a result, which caused her death.
We were successful in our arguments as to the causes of the decedent’s infection, the appropriate treatment that was rendered to her at the nursing home in the context of the treatment that was rendered to her at co-defendant’s hospital as she was transferred to the nursing home from the hospital and back again on several occasions.
