Perri and Leis Win Pre-answer Dismissal
Carl Perri and Matthew Leis from Clausen Miller’s Professional Liability Practice Group recently obtained a pre-answer dismissal for their client. The case involves complex claims on the design and construction of a mixed retail and housing development. Issues of code compliance were raised by plaintiff, who sought various equitable and monetary damages. We successfully argued that as a municipal engineer, the immunity provided under N.J.S.A. 59:3-3 applied, and further argued that plaintiff’s claims failed to show a proximate connection between our client’s work and plaintiff’s alleged damages. This resulted in an early, low cost dismissal for our client.
