Ramy Elmasri Discusses “Passive Shipper” Liability in Interview with FreightWaves
Shareholder and Texas Managing Partner Ramy Elmasri was recently interviewed by FreightWaves about the Texas Supreme Court’s decision in In re Home Depot U.S.A., Inc., which denied a plaintiff’s attempt to expand liability for a trucking accident to additional parties outside of those who owned and operated the vehicle.
In the article, Ramy highlighted the unique nature of the case, agreeing with the trial court’s original judgment that there was no precedent to expand liability beyond the involved actors. He said that in Texas “no one really has tried this before.”
Additionally, he explained the outcome of the case and pointed to previous attempts to expand liability and “increase the deep pockets aspect of it.”
