Congratulations to Michael Raudebaugh on successfully obtaining appellate affirmance of a jury verdict in a case involving an Arkansas building collapse that destroyed an adjacent property. The court upheld the jury’s verdict, awarding the plaintiff damages equal to the building’s fair market value at the time of the accident, rather than the replacement value.

Clausen Miller Wins Florida Fifth District Appeal

Clausen Miller recently prevailed on appeal before Florida’s Fifth District Court of Appeal. Following briefing and oral argument by Florida partner Michael Raudebaugh, the court unanimously affirmed summary judgment in favor of our client. This decision reinforces Florida’s interpretation of workers’ compensation “horizontal immunity” for subcontractors on the same project.

Kollross Secures Affirmance – Illinois Appellate Court Rejects COVID-19 BI Coverage Claim

Congratulations to Melinda Kollross on securing a unanimous affirmance by an Illinois Appellate Court on behalf of her insurer client in a COVID-19 business interruption coverage claim. The appellate court upheld the circuit court’s dismissal of the claim under a policy’s Tenants Prohibited Access (“TPA”) coverage provision, finding that a landlord’s compliance with government shutdown orders is not a “physical” obstruction to access as required for TPA coverage to exist, and that the policy’s Contamination Exclusion bars coverage.

US Supreme Court Overrules Chevron

Clausen Miller Appellate & Trial Monitoring Practice Chair Melinda Kollross and Partner Don Sampen analyze the end of Chevron deference after the US Supreme Court holds that courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority. Kollross and Sampen authored an amicus brief in Loper Bright Enterprises, et al v. Raimondo, Secretary of Commerce, et al, No. 22–451, on behalf of the DRI Center for Law & Public Policy in this monumental case.

Ferrini and Elmasri Score Win in 5th Circuit Federal Court of Appeals
