Nicholas Travis and Mykal Hill Secure Dismissal with Prejudice of Property Coverage Dispute in Florida

Congratulations to Nicholas Travis and Mykal Hill on securing a dismissal with prejudice of a first party property claim filed one week before the statute of limitations expired. The court ruled that the property owner’s Notice of Intent to Initiate Litigation failed to comply with § 627.70152 of the Florida Statutes, as, inter alia, the notice failed to provide with specificity the alleged acts or omissions of the insurer giving rise to the lawsuit. The property owner also would not be able to refile a compliant notice within the five-year statute of limitations.
