Daniel P. Johnston is a partner with Clausen Miller P.C. who focuses his practice on representing national insurance companies and risk retention groups involved in complex coverage and other commercial disputes, including bad faith actions.
As an experienced litigator, Dan represents his clients in state and federal courts in coverage litigation involving primary, umbrella and excess insurance policies with an emphasis on general liability, construction defect, advertising injury, professional liability, director and officer, product liability, environmental and mass tort, intellectual property and extra-contractual liability claims.
Outside of the litigation context, Dan counsels insurers on coverage, claims handling, policy drafting and bad faith issues, as well as provides strategic analysis related to the resolution of coverage disputes.
In addition to his insurance coverage practice, Dan has significant experience in prosecuting and defending general commercial litigation and disputes as well as litigating direct defense (including construction defect, premise liability, and products claims), professional liability and employment claims.
Dan is licensed to practice in the State of Illinois, the United States District Courts for the Northern, Central and Southern Districts of Illinois and the United States Court of Appeals for the Seventh Circuit. Dan has also been admitted pro hac vice in numerous state and federal jurisdictions throughout the United States.
Dan is a member of the DRI and Chicago Bar Association, and serves as a member of the CBA’s Judicial Evaluation Committee.
