Southern District of Florida Amends Local Rules to Allow Mediation via Videoconference

The Southern District of Florida’s Local Rule 16.2 will be amended to allow videoconference mediation hearings. The rule also stipulates that unless ordered otherwise, mediation hearings will be held via videoconference if parties cannot agree on the format.

Introduction

Illinois has consistently required damage to property other than repair and replacement of faulty construction to implicate coverage under a commercial general liability policy. The basis for doing so is rooted in the insuring language of the typical CGL policy that limits coverage to “property damage” caused by an “occurrence” in the policy period.
