Fifth District Court of Appeals Reverses Summary Judgment Finding Insured Had No Standing to Sue
The Court of Appeal of Florida, Fifth District recently reversed a trial court’s entry of summary judgment in favor of insurer Tower Hill.
The trial court entered summary judgment in favor of Tower Hill, finding that the insured lacked standing to sue because she had assigned her policy rights to a third party contractor. However, because the scope of the assignment was limited to work performed by the contractor – and the contractor performed no work – as opposed to an assignment including all the insured’s rights under the policy, the Fifth District Court of Appeal reversed the decision.
