Clausen Miller Obtains Summary Judgment in Construction Dispute
Brian Riordan, James Weck and Katherine Kuhn obtained summary judgment in the Cook County Law Division, Cook County, Illinois in a construction injury claim that involved our client and other construction companies.
Plaintiff claimed that he sustained injuries while descending a temporary set of stairs on a construction project. According to the plaintiff, the temporary stairs were unsafe due to insufficient slip resistance. Plaintiff attempted to hold our client liable for his injuries under the theories of general negligence, construction negligence, and premises liability.
In our summary judgment motion, we successfully argued Plaintiff’s claims were without merit as our client, as owner of the real property, had no duties or responsibilities related to safety-related matters, the stairs, or the construction project. The evidence and testimony presented confirmed this fact. The plaintiff could not provide any evidence to show that our client breached any duties or that any of its actions or inactions caused or were a proximate cause of the plaintiff’s injuries.
The Court agreed with our position and dismissed all claims against our client with prejudice, thereby avoiding a lengthy trial slated to begin in early January 2024.
