Ferrini and Elmasri Score Win in 5th Circuit Federal Court of Appeals
Clausen Miller’s Appellate & Trial Monitoring Practice Group achieved an affirmance and dismissal this week from the 5th Circuit Court of Appeals. In Kreb v. Integra Aviation, LLC, the plaintiff tried to litigate claims in federal court in Texas when he had an action pending before the Department of Labor on similar employment-related issues. Joseph Ferrini of the Appellate & Trial Monitoring Group and Ramy Elmasri, Managing Partner of our Texas office, successfully argued that plaintiff’s federal action should be dismissed as it would infringe upon the Department of Labor’s ongoing adjudication of the claims before it. The 5th Circuit unanimously agreed and dismissed the action on subject matter jurisdiction grounds. Ramy secured the trial court victory, with Joe obtaining the appellate win.
